1. Acceptance of Terms
By installing, creating an account or using the TopGames platform, you agree to these Terms of Use. If you do not agree, do not use the Platform. Acceptance is recorded electronically at the moment you subscribe.
You must be at least 13 years old. If you are under 18, use depends on the assistance or representation of your parents or legal guardians, as per art. 4 of the Brazilian Civil Code. The Platform may request proof of this authorization and suspend non-compliant accounts.
2. Definitions
- Platform: TopGames launcher, websites and other services operated by Diogo Véras.
- Account: access credentials tied to an email and a device.
- Subscription: paid plan for recurring access to the Catalog.
- Catalog: set of games available in each active plan.
- Content: games, executables, updates, graphic and audio assets, and any data provided by the Platform.
- User Content: data you submit (display name, profile picture, messages, settings).
3. Registration and account security
Registration is done via social login (e.g., Google) or by email and password. You are fully responsible for the information provided and for any activity performed on your Account.
- It is forbidden to share, sell, rent or transfer the Account to third parties.
- The Platform binds the Account to the registered device. The same Account cannot be used simultaneously on multiple devices; attempts at parallel use terminate the previous session.
- You must notify TopGames immediately in case of unauthorized use, suspected intrusion or loss of credentials.
- When using social login, you authorize the Platform to handle the provider basic data (name, email, photo) as per the Privacy Policy.
4. License of use
TopGames grants you a personal, non-exclusive, non-transferable, non-sublicensable and revocable license, limited to domestic and non-commercial use of the Content, while the Subscription is active.
The Content is licensed, not sold. This license does not grant you any title, intellectual property, source code or economic exploitation right over the games, brand or software of the Platform.
The following is expressly prohibited:
- copying, distributing, sublicensing, selling, renting, lending or transmitting the Content;
- reverse engineering, decompiling or deobfuscating the software, except within the strict limits of the law;
- removing, altering or hiding proprietary notices, credits or trademarks.
5. Subscription, billing and auto-renewal
The Subscription is billed on a recurring basis, on the cycle informed at the time of contracting (monthly, unless otherwise indicated). Current prices are displayed on the /plans page and at the payment provider checkout.
- Payment is processed by Paddle.com Market Limited (United Kingdom), acting as the Merchant of Record. Paddle offers, depending on the user country: credit/debit card, PayPal, Google Pay, Apple Pay and Pix (Brazil).
- Charges via credit card, PayPal and Google Pay renew automatically at the end of each cycle, unless previously canceled.
- Charges via Pix are one-time payments with 30 days of access, with no auto-renewal. To keep access, a new purchase must be made at the end of the period.
- In case of payment failure (recurring subscriptions), the Account enters a grace period of up to 7 days for regularization. If the failure persists, access is suspended until new confirmation.
- TopGames may change prices, plans and benefits with at least 30 days prior notice by email and/or notice on the Platform. You may cancel before the next charge if you do not agree.
6. Refund policy
You are entitled to a full refund of the Subscription if you meet all the following conditions:
- Deadline: the request must be made within 7 days from the purchase or renewal.
- Usage: total playtime, across all games in the Subscription Catalog, must be under 2 hours.
Failure to meet any of these requirements means the refund will not be granted. Time calculation is done automatically by the Platform based on recorded play sessions.
Subscription cancellation is distinct from a refund. You may cancel anytime and keep access until the end of the cycle already paid, but cancellation does NOT return amounts paid.
TopRacing: as a standalone monthly subscription, sold separately from the plans, it is subject to the same refund policy as the other Subscriptions (request within 7 days of purchase or renewal and total playtime on TopRacing under 2 hours). Cancellation follows the rule in the previous paragraph.
Legal basis: by subscribing, you expressly consent to the immediate start of digital service delivery. Use constitutes effective enjoyment of the content, mitigating the right of withdrawal provided in art. 49 of the Brazilian Consumer Defense Code under this policy.
Refund requests must be sent to support@topgames.app.br, with a response time of up to 7 business days.
7. Cancellation and termination
By user initiative: you can cancel the Subscription anytime from the "Subscription" tab in the launcher. Cancellation takes effect at the end of the cycle already paid. You keep access until that date and are not charged again.
By TopGames initiative: the Platform may suspend or terminate the Account, with or without prior notice, in case of:
- violation of these Terms or applicable laws;
- fraud, undue chargeback or payment reversal;
- misuse, automation, cheating, exploits or attempts to bypass security mechanisms;
- sharing of credentials or multiple accounts;
- total termination of the service by TopGames, with reasonable prior notice.
Termination due to violation does not entitle a refund. Total termination of the service, by exclusive initiative of the Platform, generates a proportional refund of the days remaining in the paid cycle.
8. User conduct
When using the Platform, you commit not to:
- use cheats, bots, scripts, modifications or any software that alters the behavior of the games or Platform;
- exploit flaws, bugs or vulnerabilities without immediately reporting them to TopGames;
- distribute, transmit or disclose illegal, offensive, discriminatory, pornographic, threatening content or content that infringes third party rights;
- engage in harassment, hate speech or any form of abuse against other users;
- attempt to access restricted areas, data of other users or administrative resources of the Platform;
- perform reverse engineering, decompilation or deobfuscation of the software, except as allowed by law;
- create multiple accounts to bypass limits, bans or promotional offers;
- resell or transfer, in whole or in part, your Account or the Subscription benefits.
9. User content
By submitting User Content (display name, profile picture, messages, settings), you declare that you are the holder or have all the authorizations needed for its display.
You grant TopGames a non-exclusive, free, worldwide license, for the term of legal copyright protection, to reproduce, display, store and adapt the User Content, solely for purposes of operating the Platform (display your profile to other users, integrate with games, etc.).
TopGames may remove, without prior notice, any User Content that violates these Terms or applicable legislation.
10. Intellectual property
All intellectual property rights over the games, software, brand, logos, texts, images, sounds and other elements of the Platform are owned by Diogo Véras or its licensors.
These rights are protected by Brazilian Law No. 9.279/1996 (Trademarks and Patents), Law No. 9.609/1998 (Software) and Law No. 9.610/1998 (Copyright). Any use outside the terms of the license granted in item 4 is forbidden.
11. Suspension, ban and appeal
The Platform may apply, according to the severity of the violation:
- Warning: email notification describing the conduct.
- Temporary suspension: from 1 to 30 days, with no proportional refund.
- Permanent ban: Account termination, with no refund.
In compliance with Brazilian Law No. 14.852/2024 (Legal Framework for Electronic Games), you have the right to appeal disciplinary sanctions by sending a justified appeal, within 15 days of notification, to support@topgames.app.br. The review will be conducted by a team distinct from the one that applied the sanction, with a response within 30 days.
12. Privacy and data protection (LGPD)
Personal data processing follows Brazilian Law No. 13.709/2018 (LGPD) and the Platform Privacy Policy, which details purposes, legal bases, retention periods and rights of the data subject.
You have the right to, among others:
- confirmation of the existence of processing and access to the data;
- correction of incomplete, inaccurate or outdated data;
- anonymization, blocking or deletion of unnecessary data;
- data portability;
- revocation of consent, with effect on future processing.

13. Limitation of liability
TopGames makes reasonable efforts to keep the Platform stable, secure and available, but:
- does not guarantee that operation will be uninterrupted or entirely error-free;
- is not responsible for unavailability due to force majeure, accidents, failures of payment providers, internet infrastructure or third parties;
- is not responsible for damages from the user use of the games, including loss of progress or data when saved exclusively on local device;
- is not responsible for content, policies or practices of third party services (e.g., TikTok, Discord, payment providers) that may be integrated or referenced.
TopGames liability, when applicable, follows the regime of the Brazilian Consumer Defense Code and is limited, in any case, to the amount actually paid by the user in the 12 months prior to the event.
14. Changes to these terms
TopGames may change these Terms at any time. Material changes (affecting rights, prices or refund policy) will be communicated with at least 30 days notice by email and Platform notice.
If you do not agree with the changes, you may cancel the Subscription at no cost before they take effect. Continued use of the Platform after the effective date implies acceptance of the new Terms.
This version of the Terms is 1.1.0, effective from May 27, 2026.
15. Governing law and jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil, in particular the Consumer Defense Code, LGPD, Legal Framework for Electronic Games and intellectual property legislation.
The court of the consumer domicile is elected to resolve any disputes, with waiver of any other, no matter how privileged, in accordance with the protective regime of the Brazilian CDC.
